1. Acceptance of Terms
By downloading, accessing, or using the Yutova application (“Yutova,” “the App,” or “the Service”), operated by Mariam Dabaghyan IE (“we,” “us,” or “the Company”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, please don't use the Service.
If you are under the age of majority in your jurisdiction, you may only use Yutova with the involvement and consent of a parent or legal guardian, to the extent required by applicable law. We do not knowingly permit use of Yutova by anyone below the minimum age stated in Section 2, regardless of parental consent.
We reserve the right to decline or suspend service to a user in cases of abuse, fraud, or violation of these Terms, as described further in Section 9.
2. Eligibility
You must be at least 13 years old to use Yutova. By using the Service, you confirm that you meet this requirement.
3. Description of the Service
Yutova is an AI-assisted journaling and self-reflection companion. You write or speak journal entries, and the Service generates personalized reflections based on your entries, your selected context, and — once there is genuine, repeated evidence across multiple entries — recurring patterns it may gently point out.
Yutova is not a medical device, and it does not provide medical, psychological, psychiatric, or therapeutic advice, diagnosis, or treatment. It is not a substitute for professional mental health care. If you are experiencing a mental health crisis or having thoughts of self-harm, please contact a licensed professional or a crisis service in your area immediately (in the U.S., you can call or text 988).
4. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Yutova for your personal, non-commercial use. You may not sublicense, rent, lease, sell, or otherwise transfer your rights under this license.
If you downloaded Yutova through the Apple App Store, this license is further limited to use on Apple-branded devices you own or control, as permitted by Apple's Usage Rules, and may extend to accounts associated with you through Family Sharing.
If you downloaded Yutova through Google Play, this license is subject to the Google Play Terms of Service instead.
5. Your Content
You retain all ownership rights to the journal entries and other content you create in Yutova (“User Content”). We don't claim ownership of your User Content. By submitting User Content, you grant us a limited license to store, process, and back it up solely to operate and provide the Service to you — including generating your reflections and maintaining disaster-recovery copies — and for no other purpose. See our Privacy Policy for full detail on how your data is handled.
6. AI-Generated Content
Reflections, insights, patterns, suggestions, and any other AI-generated content (“AI Content”) are produced automatically based on your input and are intended for personal reflection only. AI Content:
- May not always be accurate, complete, or the right fit for your specific situation
- Does not constitute professional, medical, psychological, or therapeutic advice
- Should not be relied on as the sole basis for any significant personal, medical, or financial decision
AI Content may not always land the way it was intended to. If a reflection feels wrong, unhelpful, or upsetting, you're free to disregard it — and if AI Content ever causes you distress rather than support, we'd genuinely like you to reach out to us, and we'd also encourage reaching out to a mental health professional.
You're solely responsible for how you use or act on any AI Content.
7. Subscriptions & Billing
Certain features of Yutova are offered on a subscription basis.
Auto-Renewal: Subscriptions renew automatically for the same duration and at the then-current price unless canceled at least 24 hours before the end of the current period.
Billing: If you subscribed through the Apple App Store, payment is charged to your Apple ID and must be managed through your Apple ID account settings. If you subscribed through Google Play, the same applies to your Google Play account. We cannot directly process cancellations or billing changes made through either platform.
Free Trials: If a free trial is offered, you'll be automatically charged at the end of the trial unless you cancel first. We may modify or cancel free trial offers at any time.
Refunds: All billing, refunds, and cancellations for in-app purchases are handled by Apple or Google under their own policies, and — except where required by law — are not directly processed or guaranteed by us.
8. Acceptable Use
You agree not to:
- Use Yutova for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract the underlying models or source code of the Service
- Use the Service to harass, abuse, or harm another person
- Attempt to circumvent any subscription, security, or access-control mechanism
- Use bots or scrapers to access the Service
- Attempt to manipulate or “jailbreak” Yutova's AI features to behave outside their intended purpose, or to bypass safety features
- Share your account credentials with anyone else, or use an account registered to someone else
We reserve the right to suspend or terminate access for anyone who violates these Terms.
9. Account & Termination
You may delete your account at any time from within the app's settings. Upon deletion, your User Content is removed according to the timeline described in our Privacy Policy.
We may suspend or terminate your access if we reasonably believe you've violated these Terms, engaged in fraudulent activity, or posed a risk to the Service or other users. Except in cases of suspected fraud, illegal activity, or risk to others, we'll make a reasonable effort to give advance notice and a chance to respond before terminating your account — this may be part of your regular emotional-wellness routine, and we don't take that lightly.
10. Intellectual Property
Aside from your User Content, all intellectual property in the Service — including the Yutova name, logo, design, software, and underlying models — belongs to Mariam Dabaghyan IE or its licensors. Nothing in these Terms grants you rights to our trademarks, branding, or technology beyond the limited license in Section 4.
11. Modification of the Service
We may modify, suspend, or discontinue any part of the Service at any time. If we remove a feature included in your paid subscription tier, we'll give reasonable advance notice where practical, and you may be entitled to a prorated refund through Apple's or Google's standard policies for material reductions in paid functionality.
12. Disclaimer of Warranties
The Services are provided on an “as-is” basis without any warranties, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Yutova, its affiliates, and third-party service providers disclaim all warranties to the fullest extent permitted by law.
13. Limitation of Liability
You expressly understand and agree that Yutova shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including damages for loss of profits, goodwill, use, data, or other intangible losses.
14. Intellectual Property Infringement Claims
You acknowledge that in the event of any third-party claim that the Service or your use of it infringes their intellectual property rights, Mariam Dabaghyan IE — not Apple or Google — is solely responsible for investigating, defending, and resolving that claim.
15. Indemnification
You agree to indemnify and hold harmless Mariam Dabaghyan IE and its officers, directors, employees, and agents from claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.
16. Third-Party Services
Certain features rely on third-party services, including cloud hosting and AI model providers — including OpenAI, for guided journaling prompt generation. Your use of those features is also subject to the relevant provider's own terms. We aren't responsible for the practices of third-party services.
17. Force Majeure
We won't be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including outages of third-party infrastructure or AI providers we rely on, natural disasters, acts of government, or internet/network failures.
18. Legal & Export Compliance
By using the Service, you represent that you're not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you're not on any U.S. Government list of prohibited or restricted parties.
19. Compliance with Third-Party Agreements
You're responsible for complying with any applicable third-party agreements when using the Service — for example, your mobile carrier's data plan terms.
20. Privacy
Our Privacy Policy explains how we collect, use, store, and protect your personal information and journal content, and is incorporated into these Terms by reference.
21. California Consumer Rights Notice
Under California Civil Code Section 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (916) 445-1254 or (916) 928-1227.
22. Changes to These Terms
We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services.
Please review these Terms of Service regularly. Your continued use of the Services after the effectiveness of such changes will constitute acceptance of and agreement to any such changes.
